Terms of use
The rules for using Efespay, for businesses and their teams.
Last updated: October 10, 2026
This text is a draft prepared for Efespay's pre-pilot service model and is awaiting legal review. It will be reviewed and updated before the live service starts.
This translation is provided for convenience. In case of any conflict, the Turkish version prevails.
1.Parties and definitions
These terms govern the use of the Efespay service (the "Service") provided by Ahmet Aksungur (Aksungur Yazılım) (the "Service Provider"). Anyone who signs up for or uses the Service is deemed to have accepted these terms.
- User: a natural person who opens an Efespay account.
- Business: the workspace of a company or sole proprietorship in Efespay; the team, payment connections and subscription belong to the business.
- Team member: the owner of a business or a user the owner invites with a role.
- Customer: a person who pays a business through the payment infrastructure the business connects to Efespay.
2.Description of the Service
Efespay is a subscription-based software service, accessed on the web and through the mobile app, that aims to bring businesses' bank virtual POS terminals, payment institution connections and collection operations together in one API and dashboard. The Service is in pre-pilot preparation; modules open gradually, and the modules available for use are shown in the dashboard. The scope and limits of plans are stated in the dashboard and in the quote.
3.Account and team
- You provide accurate and up-to-date information when you open an account; you may be asked to verify your email address and phone.
- You don't share your password with anyone and you're responsible for actions taken in your account. If you notice unauthorized use, tell us immediately.
- The business owner invites team members with roles (finance, operations, developer, viewer); team members can only do what their role allows. The business is responsible for its team's actions.
- Ownership of a business can be given to another team member by the current owner.
4.Responsibilities of the business
- The business is responsible for the accuracy and lawfulness of the business, customer and order information entered in Efespay or sent through the API.
- The business is responsible for keeping the legal name, tax and contact details given in the live application accurate and up to date. The Service Provider may review the application, request more information or reject it, stating the reason.
- The business is the data controller for its customers' personal data and is responsible for informing them and, where necessary, obtaining their explicit consent. Efespay is the data processor for this data (see the KVKK privacy notice).
- Obtaining the consents needed for SMS and email sent on behalf of the business, and complying with commercial message legislation, are the business's responsibility.
5.Payment connections and collections
Payments a business receives from its customers take place on the infrastructure of the bank or authorized payment institution with which the business has its own agreement; collection and fund transfers are carried out on these institutions' contracted infrastructure. Efespay is not a bank or a payment institution; it doesn't hold customer funds in its own account, doesn't operate user balances and doesn't pay businesses from its own account. Efespay manages payment instructions, results and operation records.
- Bank and payment institution fees, installments, refunds and chargebacks are governed by the agreement between the business and the institution concerned.
- Refunds are made through the provider that collected the original payment; the total refunded can't exceed the amount collected.
- A transaction whose result isn't final at the provider isn't treated as failed; it stays pending until the result is queried from the provider.
- Whether a payment connection can be used depends on the provider's rules and the business's agreement with that provider.
6.Efespay Assistant
- The assistant's replies are generated by AI and may contain errors; they are not a substitute for legal, financial or tax advice.
- The assistant only looks at records within the user's permissions; actions that send or save something are taken only with the user's approval and are logged.
- The monthly message quota depends on the plan; when the quota is used up, the assistant can't be used until the next month unless the plan is upgraded.
7.Subscription, trial and payment
- Plans are offered monthly or yearly; plans without a listed price are sold by quote. Prices are published excluding VAT.
- New businesses start with a free 30-day trial; no card is needed for the trial. During the trial, the Professional plan's limits apply.
- When the trial or subscription ends, the dashboard becomes read-only; records aren't deleted.
- Unless canceled, the subscription renews with the same plan at the end of each period and the period fee is charged to the saved card.
- Cancellation takes effect at the end of the paid period. No refund is given for a used or started period.
- When you change plans, the new plan starts a new period as soon as the payment is approved; no cash refund is given for the unused days of the previous plan.
- Price changes are emailed to the business owner before they take effect and don't affect a period that's already paid.
Details of the purchase are in the pre-contract information form, the distance sales agreement and the cancellation and refund policy.
8.Plan limits and fair use
Each plan has a team member limit and a monthly assistant message limit. When a limit is reached, existing records aren't affected; only new additions are blocked. SMS are sent from the business's own SMS provider account and paid to that provider. Automated use that puts unusual load on the Service's infrastructure may be limited.
9.Data ownership
Records the business enters in Efespay, or that are created in Efespay on the business's behalf, belong to the business. The Service Provider processes these records only to provide the Service, keep it secure and meet its legal obligations; it doesn't sell them or use them for advertising.
10.Prohibited use
- Using the Service for unlawful purposes or to process other people's personal data without a legal basis.
- Trying to gain unauthorized access to another business's or customer's records, or trying to bypass security measures.
- Reverse engineering, copying or reselling the Service without permission.
- Sending unsolicited bulk messages (spam).
11.Service continuity and support
We take reasonable care to keep the Service running without interruption and announce planned maintenance in advance where possible. Interruptions caused by third-party services (banks, payment institutions, SMS providers) are outside the Service Provider's control. For support, write to info@efespay.com.
12.Suspension and termination
In case of a serious breach of these terms, failure to meet payment obligations, or use that endangers the Service's security, the Service Provider may suspend the account or the business, giving notice in advance where possible. The business can cancel its subscription at any time.
13.Limitation of liability
To the extent permitted by law, the Service Provider isn't liable for errors in the records the business enters, for decisions the business makes, or for the operation of third-party services (banks, payment institutions). The statutory rights of users who are consumers are reserved.
14.Changes and disputes
- Significant changes to these terms are announced by email or in-app notification before they take effect.
- These terms are governed by Turkish law. The courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction over disputes; the jurisdiction of consumer arbitration committees and consumer courts is reserved for users who are consumers.
- If any provision is held invalid, the other provisions are not affected.
